Description

Pregnancy and caregiving responsibilities present unique challenges for both workers and employers. Managers must balance the need for continuity of business operations with regulations that protect expecting mothers and new parents from discrimination and retaliation.

For new moms, the stress of pregnancy is too often compounded by unlawful mistreatment from bosses who are overly concerned with their bottom line. This CLE program will include practical guidance for employment law practitioners and in-house counsel looking to advise clients on this evolving area of the law.

This program will address topics such as:

  • The Pregnant Workers Fairness Act and PUMP For Nursing Mothers Act, recently signed into law by President Biden as part of the $1.7 trillion omnibus spending package
  • Parental leave requirements at the federal level and in New York
  • Reasonable accommodations requirements for pregnant employees under the New York State and City Human Rights Laws
  • Common types of caregiver-related claims and defenses

Lecturer Bios

Lauren M. Paxton, Esq.

Lauren is a Partner with Calcagni & Kanefsky. She focuses her practice on litigation and internal investigations, concentrating on all matters of employment law.

A seasoned trial attorney, Lauren has vast experience in federal, state, and regulatory matters, as well as arbitration. She regularly handles employment litigation, workplace investigations, government inquiries, high-stakes workplace disputes, and C-suite employment negotiations.

Lauren is adept at identifying litigation risk in the workplace and crafting custom-tailored solutions to mitigate exposure. She provides training, prepares legally compliant workplace policies and procedures, and counsels her clients throughout the employee lifecycle, from onboarding through performance management, dispute resolution, restructuring, and terminations. Lauren is often called upon to structure and negotiate employment agreements, restrictive covenants (including non-competition clauses), separation agreements, and executive compensation arrangements.

Susan Crumiller, Esq.

Susan is the Founding Attorney at Crumiller. Susan founded the Feminist Litigation Firm following the birth of her second child, after her employer began pressuring her to return to work only seven weeks into her maternity leave, in violation of their agreement that she could take five months off to bond with her baby. During this awful time, Susan kept thinking about other new moms who lacked the resources and job security to return to work on their own terms, as she had. Susan decided to create the Crumiller firm, dedicated to fighting for rights of new working parents to integrate their work and family lives without shame or fear of reprisal. Before starting the firm, Susan spent ten years representing tenants in fast-paced landlord-tenant litigation, first-seating a dozen trials and winning appeals.

Susan received her Bachelor’s Degree in 2002 from Tulane University, where she majored in music theory, English, and sociology. She continued her education at NYU Law School, where she graduated in 2006.

Susan is a volunteer Small Claims Arbitrator and a singer in the Cecilia Chorus of New York where she performs at Carnegie Hall twice a year. She recently served as the President of the Board of Directors for the Gender Equality Law Center. She lives in Park Slope with her handsome husband and two daughters. Of all her accomplishments, she is most proud of her experience as the tooth fairy.

Susan can be reached at susan (at) crumiller (dot) com.
