Description

As the insurance industry continues to evolve at a rapid pace, litigation involving uninsured and underinsured motorist (UM/UIM) coverage has grown increasingly complex. This CLE course explores the shifting terrain of modern coverage disputes, examining everything from the legal uncertainties surrounding policy stacking to the insurance challenges presented by autonomous vehicles, rideshare platforms, and telematics-based underwriting. With growing exposure to claims tied to data privacy, automation, and ambiguous policy language, legal practitioners must be prepared to adapt.

This session provides a practical and comprehensive overview of today’s most pressing coverage issues. Attendees will gain insights into recent case developments, strategic litigation approaches, and risk management tactics that span multiple jurisdictions. Whether evaluating potential bad faith exposure or addressing coverage gaps in the era of driverless cars, participants will leave with valuable tools to better protect clients and anticipate future trends.

Learning Objectives

  • Differentiate between UM and UIM coverage and understand how stacking rules vary by state
  • Explore how autonomous vehicle technology is redefining coverage interpretation and dispute resolution
  • Examine how the evolving status of rideshare drivers affects policy triggers and claims handling
  • Assess the role of data—such as mobile apps and telematics—in bad faith litigation
  • Develop effective litigation strategies, including expert coordination, multi-policy analysis, and jurisdictional considerations

Lecturer Bio

Cassie D. Preston, Esq.

Cassie Preston is Senior Counsel in GRSM’s Atlanta office. On behalf of the firm, she defends matters in a variety of practice areas from inception through trial. Cassie has a seasoned history of successfully litigating cases in state and federal courts throughout the southeastern United States.

Cassie has handled a multitude of claims implicating a party’s coverage and, particularly, historically specialized in a relatively unknown sub-area of insurance law known as subrogation. Litigating matters by way of subrogation not only allowed her to gain intricate knowledge of the legalities surrounding insurance related disputes, but also provided the vehicle to gain particularized knowledge in complex cases involving product defects, construction defects, and other claims in tort, which caused injury to person and property, as well as contractual disputes.

In addition, Cassie is accredited by the United States Veterans Association and won on appeal, at the regional level, a veteran’s matter involving the improper reduction of benefits due to the United States Department of Veterans Affairs contradicting its own precedent involving presumptive illnesses directly linked to a product known as Agent Orange, which was heavily utilized during the Vietnam War. Cassie also has vast experience handling Plaintiffs’ personal injury matters in both state and federal courts and in the States of Georgia, Alabama, Florida, Mississippi, and Tennessee.
